No, you are not. You need confirmed permission to be able to use their works. Their policy states that anyone may use their characters for non-commercial offline use. This would be non-commercial, but online. However, some people have nitrome stuff on Deviantart, which is online. Could I say that my making one of their characters is a form of fan art? | |

| um, aren't we using sprites from Nintendo and such? so why can we use sprites from Nintendo but not other flash games? The whole ssf2 isn't really legal in general...
Or is this just on the basis of "Nintendo doesn't care" | |

Or is this just on the basis of "Nintendo doesn't care" Many people made flash games about video game characters. Mario, Legend of Zelda, Donkey Kong, ect. If Nintendo or any other video game company does care, then most fan made would be illegal and their creators will be sued for copyrights. Fan made custom game characters creators, however, does care. They probally won't sue, but the one who uses the sprites without permission would be accused of stealing. We don't want an angry programmer knocking on our door, do we? | |
